1. Acceptance of Terms

By creating an account or using LoadKaro in any capacity (as a shipper, driver, or otherwise), you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use our services. We may update these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms.

2. Description of Service

LoadKaro provides a technology platform that facilitates the connection between shippers (persons or businesses who need to move goods) and drivers (persons or entities who provide transportation). We do not act as a carrier, freight broker, or employer of drivers. We are not responsible for the actual transportation of goods, the conduct of users, or the terms of any agreement between shippers and drivers. Our role is limited to providing the platform, tools, and support to enable such connections.

3. Eligibility and Account Registration

• You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our services.
• You must provide accurate, current, and complete information during registration and keep your account information updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
• Drivers may be required to submit identity and vehicle documentation and comply with verification processes as specified by LoadKaro or applicable law.

4. User Conduct and Obligations

You agree to use the platform only for lawful purposes and in accordance with these Terms. You must not:

• Provide false or misleading information or impersonate any person or entity.
• Use the platform for any illegal or unauthorized purpose, including transporting prohibited goods.
• Harass, abuse, or harm other users, or interfere with the proper operation of the platform.
• Circumvent or attempt to circumvent platform fees, security measures, or policies.
• Use automated means (e.g., bots or scrapers) to access the platform without our prior written consent.

5. Orders, Bids, and Payments

• Shippers may post loads and accept bids; drivers may submit bids and perform deliveries in accordance with the order terms agreed on the platform.
• Payment terms, methods, and any platform fees will be as displayed on the platform or communicated to you. You are responsible for any taxes applicable to your transactions.
• Disputes regarding payment or delivery should be reported through the platform. We may facilitate resolution but are not obligated to guarantee outcomes between users.

6. Ratings and Reviews

Users may be able to rate and review each other. You must provide fair and honest feedback. LoadKaro may use ratings to improve the platform and may take action against users who abuse the rating system.

7. Intellectual Property and License

The LoadKaro platform, including its design, content, software, and branding, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the platform for its intended purpose in accordance with these Terms. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Disclaimers

The platform and services are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted, error-free, or secure operation of the platform. Your use of the platform and any transactions with other users are at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, LoadKaro and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the platform or your interactions with other users. Our total liability for any claims arising from or related to these Terms or the platform shall not exceed the amount you paid to LoadKaro (if any) in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless LoadKaro and its affiliates and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Termination and Suspension

We may suspend or terminate your account and access to the platform at any time, with or without notice, for breach of these Terms, fraudulent or illegal activity, or for any other reason we deem appropriate. You may close your account by contacting us. Upon termination, your right to use the platform ceases; provisions that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification) will remain in effect.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the platform shall be subject to the exclusive jurisdiction of the courts of Pakistan, unless otherwise required by mandatory law.

13. General

• If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
• These Terms, together with our Privacy Policy and any other policies we publish on the platform, constitute the entire agreement between you and LoadKaro regarding the services.
